National Prosecuting Authority Challenges Magistrate Mokoena’s Impartiality in Pastor Mboro’s Bail Hearing at Palm Ridge Magistrate’s Court

In a recent development, the state has called for the recusal of Magistrate Katlego Mokoena from overseeing the case involving Pastor Paseka ‘Mboro’ Motsoeneng.

The controversy centers around accusations of bias made against Mokoena, who has been handling the proceedings since the case began.

Mboro’s Bail Hearing Update

Pastor Mboro appeared in the Palm Ridge Magistrate’s Court on Monday, September 9, for a bail hearing.

His initial bail request was denied on August 19, prompting him to file an appeal.

The case continues to unfold with heightened scrutiny.

NPA’s Allegations Against Magistrate

Phindi Mjonondwane, spokesperson for the National Prosecuting Authority (NPA) in Gauteng, detailed several concerns raised by the state.

These include claims that Magistrate Mokoena met with the defense team privately and allegedly suggested they “fix” a poorly constructed affidavit.

Additionally, there were concerns about inappropriate comments made by Mokoena to the prosecutor, criticizing his handling of the bail application.

Mjonondwane also highlighted that on September 2, Mokoena allowed a case to proceed without the proper documentation, questioning why new counsel appeared for the applicants instead of the original representation.

State’s Call for Fair Proceedings

Mjonondwane emphasized that these issues cast doubt on Mokoena’s impartiality.

The state believes it is crucial to address these concerns to ensure a fair hearing.

The court is expected to deliver a judgment on the matter by Wednesday, September 11.

Defense Responds to Allegations

In response, Mboro’s lawyer, Advocate MoAfrika wa Maila, accused the state of employing delaying tactics.

He expressed dissatisfaction with the handling of the case and criticized the state for potentially stalling the proceedings.

Advocate wa Maila also noted the financial strain on Mboro, revealing that the pastor is spending approximately R110,000 daily on legal fees due to the involvement of multiple attorneys and advocates.

Charges Against Mboro and Co-Accused

According to the NPA, Pastor Mboro and his co-accused face numerous serious charges, including kidnapping, possession of dangerous and unlicensed firearms, assault, and malicious property damage.

The legal battle continues as the case progresses through the court system.
